Evaluation Report Expertise

In the case of a dispute regarding the accuracy of the market or other value of the appraised object established in the appraisal report, including in connection with an existing other appraisal report for the same object, an examination of the appraisal report may be carried out.

The expert review of a valuation report is conducted in accordance with the legislation of the Republic of Kazakhstan on valuation activities by the Expert Council of the Chamber of Appraisers to which the appraiser who performed the valuation belongs.

The expert review of the valuation report is carried out at the initiative of the client and/or a third party disputing the valuation report.

The expert review of a valuation report is carried out at the expense of the party initiating the review.

The expert review is conducted pursuant to an agreement between the party disputing the valuation report and the Chamber of Appraisers.

The result of the expert review of a valuation report is a positive or negative expert opinion prepared by the Expert Council of the Chamber of Appraisers.

A positive opinion of the Expert Council is an expert opinion containing a conclusion that the valuation report complies with the requirements of the legislation of the Republic of Kazakhstan on valuation activities and/or confirms the value of the object of valuation as determined in the valuation report.

A negative opinion of the Expert Council is an expert opinion containing a conclusion that the valuation report does not comply with the requirements of the legislation of the Republic of Kazakhstan on valuation activities and/or refutes the value of the object of valuation as determined in the valuation report.

Disputes arising between a person challenging an appraisal report and the Chamber of appraisers that issued the expert opinion shall be considered by the court.
