This personal data processing policy has been compiled in accordance with the requirements of the Law of the Republic of Kazakhstan dated May 21, 2013, No. 94-V “On Personal Data and Their Protection” and defines the procedure for processing personal data and measures to ensure the security of the personal data of the Commonwealth (hereinafter referred to as the Operator).

1. The Operator’s primary goal and condition for carrying out its activities is to respect the rights and freedoms of individuals and citizens when processing their personal data, including the protection of their rights to privacy, personal and family secrets.
2. This Operator policy regarding the processing of personal data (hereinafter referred to as the Policy) applies to all information that the Operator may receive about visitors to the website http://estimation.kz
   
   

Terms used

Automated processing of personal data is the processing of personal data using computer technology.

Blocking of Personal Data – the temporary cessation of personal data processing (except in cases where processing is necessary to clarify the personal data).

Website – a collection of graphic and informational materials, as well as computer programs and databases, ensuring their availability on the Internet at the network address http://estimation.kz.

Personal Data Information System – a set of personal data contained in databases, along with the information technologies and technical means that ensure their processing.

Anonymization of personal data is an action that makes it impossible to determine, without the use of additional information, the ownership of personal data by a specific User or another subject of personal data.

Processing of personal data is any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

Operator – a state body, a local government body, a legal entity or an individual that, independently or jointly with other persons, organizes and/or carries out the processing of personal data, and also determines the purposes of processing personal data, the composition of personal data to be processed, and the actions (operations) performed with personal data.

 

Personal data – any information relating directly or indirectly to a specific or identifiable User of the website http://estimation.kz.

User – any visitor of the website http://estimation.kz.

Provision of personal data – actions aimed at disclosing personal data to a specific person or a specific group of persons.

Dissemination of personal data – any actions aimed at disclosing personal data to an indefinite number of persons (transfer of personal data) or familiarizing an unlimited number of persons with personal data, including the publication of personal data in the media, posting on information and telecommunications networks or providing access to personal data in any other way.

Cross-border transfer of personal data is the transfer of personal data to the territory of a foreign state to a government body of a foreign state, a foreign individual or a foreign legal entity.

Destruction of Personal Data any actions resulting in the irreversible destruction of personal data, making it impossible to restore the content of personal data in the personal data information system, and/or resulting in the destruction of physical media containing personal data.

 

3. The following personal data of the User is subject to processing:

6. Telephone numbers.
7. The website also collects and processes anonymized data about visitors (including cookies) using internet statistics services (Yandex Metrica, Google Analytics, and others).
8. The above data is hereinafter collectively referred to as “Personal Data.”
9. Purposes of personal data processing:
10. The purpose of processing the User’s personal data is to inform the User via email.
11. The Operator also has the right to send the User notifications about new products and services, special offers, and various events. The User can always unsubscribe from receiving informational messages by sending an email to the Operator at palata2020@bk.ru with the subject line “Unsubscribe from notifications about new products and services and special offers.”
12. Anonymized User data collected through internet statistics services is used to collect information about User activity on the website and to improve the quality of the website and its content.
    5. Legal Basis for Processing Personal Data
13. The Operator processes the User’s personal data only if the User completes and/or submits it independently through special forms located on the website http://estimation.kz. By completing the relevant forms and/or submitting their personal data to the Operator, the User consents to this Policy.
14. The Operator processes anonymized data about the User if this is permitted in the User’s browser settings (saving cookies and using JavaScript technology are enabled).

 

6. 6. The procedure for collecting, storing, transferring, and other types of processing personal data

The security of personal data processed by the Operator is ensured through the implementation of legal, organizational, and technical measures necessary to fully comply with the requirements of current legislation in the field of personal data protection.

1. The Operator ensures the security of personal data and takes all possible measures to prevent unauthorized persons from accessing it.
2. The User’s personal data will never, under any circumstances, be transferred to third parties, except in cases related to compliance with applicable law.
3. If inaccuracies in personal data are discovered, the User may update them independently by sending a notification to the Operator’s email address palata2020@bk.ru with the subject “Update personal data.”

The processing of personal data is unlimited. The User may withdraw their consent to personal data processing at any time by sending a notification to the Operator via e-mail to the e-mail address of the Operator palata2020@bk.ru with the remark «Withdrawal of consent to personal data processing».

 

7. Cross-border Transfer of Personal Data
8. 1. Before commencing the cross-border transfer of personal data, the operator must ensure that the foreign state to which the personal data is to be transferred ensures reliable protection of the rights of personal data subjects.
9. Cross-border transfer of personal data to foreign states that do not meet the above requirements may only be carried out with the personal data subject’s written consent to the cross-border transfer of their personal data and/or the execution of an agreement to which the personal data subject is a party.
   8. Final and Transitional Provisions
10. The User may obtain any clarifications on issues of interest regarding the processing of their personal data by contacting the Operator via email at palata2020@bk.ru.
11. Any changes to the Operator’s Personal Data Processing Policy will be reflected in this document. The Policy is valid indefinitely until it is replaced by a new version.
12. The current version of the Policy is publicly available online at http://estimation.kz.
13. The Commonwealth takes the privacy of its visitors to the www.estimation.kz website (hereinafter referred to as “you” or “website visitors”) seriously. Personalized information refers to the personal data (full name, login, or organization name) of a website visitor, as well as information about the actions you take on the website. Anonymous data refers to data that cannot be uniquely identified with a specific website visitor (e.g., website traffic statistics).
14. We use personal information about specific website visitors solely to ensure high-quality service delivery and to track their performance. We do not disclose personal data about one Commonwealth website visitor to another. We never publish personal information publicly or transfer it to third parties. The only exceptions are situations where the provision of such information to authorized government agencies is required by the current legislation of the Republic of Kazakhstan. We publish and distribute only reports based on collected anonymous data. However, these reports do not contain information that could identify the personal data of service users. We also use anonymous data for internal analysis, the purpose of which is to develop the Commonwealth’s products and services.
15. The website www.estimation.kz may contain links to other websites that are not related to our activities and are owned by third parties. We are not responsible for the accuracy, completeness, or reliability of information posted on third-party websites and assume no obligations to ensure the confidentiality of information you provide on such websites.
16. We make every effort to comply with this Privacy Policy; however, we cannot guarantee the security of information in the event of factors beyond our control that result in the disclosure of information. The website www.estimation.kz and all information posted on it are provided on an “as is” basis, without any warranties. We are not liable for any adverse consequences or for any losses incurred as a result of restricted access to the Community’s website or as a result of visiting the website and using the information posted on it.
17. The Community has the right to make changes to this Privacy Policy without the User’s consent.
